WELCOME

Welcome to TreHazelwood.com! By using the TreHazelwood.com website and booking or inquiring about a service or job, you are entering a legally binding agreement between Tré Hazelwood, LLC. and yourself based on the following Terms and Conditions. It is the client’s responsibility to carefully read these Terms and Conditions before booking or using this website. The client’s use of the TreHazelwood.com website is contingent upon their agreement and acceptance of the trehazelwood.com Privacy Policies, as well as the following Terms and Conditions. If the client does not wish to be bound by these Policies and Conditions, they should not access or use the TreHazelwood.com website or services. It is the client’s responsibility to ensure that this is thoroughly read and understood prior to booking. TreHazelwood.com has the right to modify the Terms and Conditions at any point in time without any notice to the client.

PRE-PRODUCTION REQUIREMENTS

It is the client's responsibility to obtain all necessary permissions including but not limited to locations, performances, branding, trademarked goods and logos, intellectual property, imagery, sound recordings and any other copyrighted material which will form part of the final photo, video, or film project. Where copyright material is provided by the client for incorporation into a Tré Hazelwood, LLC. product, permission must be obtained from the original copyright owner and/or material provider. It is the client's responsibility to obtain and maintain any props necessary for the project. All projects and services over $100 require a non-refundable 50% deposit in advance. All projects and services under $100 must be paid in full in advance. No liability will be accepted by Tré Hazelwood, LLC. for any delays or failure to deliver the agreed product if caused by any element which is the client's responsibility.

PRODUCTION & POST-PRODUCTION

All works undertaken will be per Tré Hazelwood, LLC. written or unwritten agreement. Any amendments or additions will be charged accordingly. Clear access for video and sound capture shall be arranged and managed by the client. If filming venues are being organized by the client, it is the client's responsibility to ensure that all production crew and supporting personnel have clear access to all relevant locations required throughout the day. Delays in production as a result of inadequate access or facilities may incur additional charges. In the event of inclement weather which in our opinion would pose a risk to health & safety of our personnel or equipment or has the potential to prevent successful video or audio capture, we reserve the right to change the date or time of filming to a more suitable date or time. In the event of filming or shooting being delayed or aborted due to the client’s failure to adhere to the agreed dates, times, access, facilities, or organization, we reserve the right to re-schedule the affected days of filming and to charge for any additional costs which arise.  No refund or credit will be given in respect of costs associated with the delayed or aborted original filming day(s). Tré Hazelwood, LLC. takes Health & Safety matters seriously and reserve the right in all instances to remove any personnel and/or equipment from a location if deemed to be unsafe or if the crew is subjected to abusive, aggressive, uninhabitable or dangerous behaviors or environments. In such circumstances, the client will be fully liable for any costs incurred or subsequently arising as a result. All projects and services include two free revisions, additional revisions will be charged. All revisions after a project or service is considered completed are charged the original cost of the project or service.

TURNAROUND TIME

The turnaround time agreed upon begins after the shooting date and once the project is paid in full. The time is calculated as business days and does not include weekends or holidays. Unexpected failures, malfunctions, and/or technical problems with equipment may delay the turnaround time. If such a delay were to occur, Tré Hazelwood, LLC. may, at its discretion and on a case by case basis, provide compensation to the client in the form of a discount. Technical difficulties or delays will not be grounds for order cancellations or refunds.

COPYRIGHT & USAGE LICENSE

COPYRIGHT & USAGE LICENSE

Tré Hazelwood, LLC. asserts its full rights as the copyright owner of all material that has been captured, processed and/or produced unless agreed otherwise. Tré Hazelwood, LLC. retains all rights to the usage of all content captured during the production of any client-commissioned project unless the rights are fully purchased. As part of photo and video services, Tré Hazelwood, LLC. will grant a time-unlimited license for use of that content to the client always. Tré Hazelwood, LLC. reserves the right to use any footage and related files from any client-commissioned project in showreels and for other promotional purposes.

PAYMENT

Tré Hazelwood, LLC. payment terms are strictly no later than 30 days from date of invoice and in the event of an order being confirmed the client accepts these terms. Tré Hazelwood, LLC. will exercise its statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if not paid according to agreed credit terms. The client shall be responsible for all collection or legal fees necessitated by late or default in payment. Full payment is required for any project to enter post-production. Tré Hazelwood, LLC. reserves the right to withhold delivery and any granting or continuation of usage license of any current work if accounts are not current or overdue invoices are not paid in full. All grants of any license to use our copyright material under this an agreement are conditional upon receipt of payment in full which shall be inclusive of any and all outstanding additional costs, taxes, expenses, fees, or charges.
